Article 1 - Definitions

In these conditions, the following is understood:

Additional agreement: an agreement by which the consumer purchases products, digital content and/or services in the in connection with a distance contract and these products, digital content and/or services are delivered by Britstyle Boutique or a third party, on the basis of an agreement between that third party and  Britstyle Boutique ;


... Right of withdrawal: The possibility for the consumer to withdraw from the distance contract within the withdrawal period;


Distance contract: A contract concluded between Britstyle Boutique and the consumer within the framework of an organized system for the distance sale of goods, digital content and/or services, whereby one or more distance communication techniques are used exclusively or partially to conclude the contract;


Model withdrawal form: The European model withdrawal form included in Appendix I to these terms and conditions;


Britstyle Boutique: The legal entity, as further defined in Article 2, that offers products, (access to) digital content and/or services to consumers at a distance in accordance with these general terms and conditions;


Distance communication technique: A means that can be used to conclude the contract without the consumer and the entrepreneur having to be in the same room at the same time;


Article 2 - Applicability


These general terms and conditions apply to every offer from Britstyle Boutique and to every distance contract concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not possible for reasonable reasons, Britstyle Boutique will indicate before the distance contract is concluded how the general terms and conditions can be viewed at Britstyle Boutique and that they will be sent immediately and free of charge at the consumer's request.
If the distance contract is concluded electronically, by derogation from paragraph 1 and before the distance contract is concluded, the text of these general terms and conditions can be made available to the consumer electronically in such a way that it can be easily stored on a durable medium. If this is not possible for reasonable reasons, before the distance contract is concluded, it will be indicated where the general terms and conditions can be viewed electronically and that they will be sent electronically or otherwise free of charge at the consumer's request.
In the event that specific product or service conditions apply in addition to these general terms and conditions, paragraphs 2 and 3 apply accordingly and the consumer can always rely on the provision that is more favorable to him in the event of conflicting conditions.

    Article 3 - The offer

    If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated in the offer.
    The offer contains a complete and accurate description of the products, digital content and/or services offered. The description is sufficiently detailed to enable the consumer to make a good assessment of the offer. If Britstyle Boutique uses images, these correspond to a true representation of the products, services and/or digital content offered. Obvious errors or obvious mistakes in the offer do not bind Britstyle Boutique.
    Every offer contains information that makes it clear to the consumer what rights and obligations are associated with accepting the offer.

    Article 4 - The contract

    The contract is concluded, subject to paragraph 4, when the consumer accepts the offer and meets the conditions attached to it. If the consumer has accepted the offer electronically, Britstyle Boutique will immediately confirm receipt of acceptance of the offer electronically. As long as receipt of this acceptance has not been confirmed by Britstyle Boutique, the consumer can revoke the contract. After receiving this confirmation, it is no longer possible for the consumer to withdraw or cancel the contract: the consumer can, however, exercise his right of withdrawal (Article 6). If the contract is concluded electronically, Britstyle Boutique will take appropriate technical and organizational measures to protect electronic data transmission and provide a secure web environment. If the consumer can pay electronically, Britstyle Boutique will take appropriate security measures. Britstyle Boutique may - within the framework of the legal provisions - inform itself about whether the consumer can meet his payment obligations, as well as about all facts and factors relevant to a responsible conclusion of the distance contract. If, as a result of this verification, Britstyle Boutique has good reasons not to conclude the contract, it is entitled to refuse an order or request or to impose special conditions for its execution .Britstyle Boutique will send the consumer the following information in writing or in a form that can be stored by the consumer on a durable medium at the latest upon delivery of the product, service or digital content: the visitor address of the Britstyle Boutique branch to which the consumer can turn in case of complaints; the conditions and the manner in which the consumer can exercise his or her right of withdrawal, or a clear notification of the exclusion of the right of withdrawal; information about guarantees and existing after-sales service; the price including all taxes of the product, service or digital content; where applicable, the delivery costs; and the method of payment, delivery or execution of the distance contract; the conditions for terminating the contract, if the contract has a duration of more than one year or is of indefinite duration; if the consumer has a right of withdrawal, the model withdrawal form. In the case of a continuing agreement, the provision in the previous paragraph only applies to the first delivery.

    Article 5 - Right of withdrawal

    The consumer may withdraw from a contract for the purchase of a product within a cooling-off period of at least 14 (fourteen) days without giving any reason. Britstyle Boutique may ask the consumer for the reason for the withdrawal, but may not oblige him to state his reasons. The cooling-off period referred to in paragraph 1 begins on the day after the consumer or a third party previously designated by him, other than the carrier, has received the product, or: if the consumer has ordered several products in one order: on the day on which the consumer or a third party designated by him has received the last product. Britstyle Boutique may refuse an order for several products with different delivery times, provided that it has clearly informed the consumer before the ordering process; if the delivery of a product consists of several shipments or parts: on the day on which the consumer or a third party designated by him has received the last shipment or part; in the case of contracts for the regular delivery of products over a fixed period of time: on the day on which the consumer or a third party designated by him has received the first product.

    For services and digital content not delivered on a physical carrier:

    The consumer can withdraw from a service contract and a contract for the delivery of digital content not delivered on a physical carrier within at least 14 days without giving any reason. Britstyle Boutique can ask the consumer for the reason for withdrawal, but does not oblige him to state his reasons. The withdrawal period referred to in paragraph 3 starts on the day after the conclusion of the contract.

    Extended withdrawal period for products, services and digital content not delivered on a physical carrier if the right of withdrawal is not informed:

    If Britstyle Boutique has not provided the consumer with the legally required information on the right of withdrawal or the model withdrawal form, the withdrawal period will expire twelve months after the expiry of the original withdrawal period in accordance with the previous paragraphs of this article. If Britstyle Boutique has provided the consumer with the information referred to in paragraph 5 within twelve months of the start of the original withdrawal period, the withdrawal period will expire 14 days after the day on which the consumer received this information.

    Article 6 - Obligations of the consumer during the cooling-off period

    During the cooling-off period, the consumer will handle the product and the packaging with care. He will only unpack or use the product to the extent necessary to check the nature, properties and functioning of the product. The principle here is that the consumer may only handle and inspect the product as he would be permitted to do in a shop.

    The consumer is only liable for a reduction in the value of the product that is due to a way that goes beyond what is permitted in paragraph 1.

    The consumer is not liable for a reduction in the value of the product if Britstyle Boutique has not provided him with all the legally required information on the right of withdrawal before or at the conclusion of the contract.

    Article 7 - Exercise of the right of withdrawal by the consumer and associated costs

    If the consumer exercises his right of withdrawal, he will notify Britstyle Boutique of this within the cooling-off period by means of the model withdrawal form or in another unambiguous manner.
    The consumer shall return the product or hand it over (to an authorized representative) to Britstyle Boutique as soon as possible, but no later than 14 days after the day following the notification referred to in paragraph 1. This is not necessary if Britstyle Boutique has offered to collect the product itself. The consumer has in any case complied with the return period if he returns the product before the cooling-off period has expired.
    The consumer returns the product with all supplied accessories, if reasonably possible, in the original condition and packaging and in accordance with the reasonable and clear instructions provided by Britstyle Boutique.
    The risk and burden of proof for the proper and timely exercise of the right of withdrawal rests with the consumer.
    The consumer bears the direct costs of returning the product. If Britstyle Boutique has not communicated that the consumer must bear these costs, or if Britstyle Boutique indicates that it will bear the costs itself, the consumer does not have to bear the costs of returning the product.
    The consumer will not bear any costs for the delivery of digital content that has not been delivered on a physical carrier if:
    he has not expressly agreed to the immediate execution of the contract prior to delivery;
    he has not declared that he will lose his right of withdrawal upon giving his consent; or
    Britstyle Boutique has failed to confirm this declaration by the consumer.
    If the consumer exercises his right of withdrawal, all additional contracts will be automatically terminated.

    Article 8 - Obligations of Britstyle Boutique in case of withdrawal

    If Britstyle Boutique enables notification of withdrawal by the consumer electronically, it will send a confirmation of receipt immediately after receiving this notification.
    Britstyle Boutique will refund all payments made by the consumer, including any delivery costs charged by Britstyle Boutique for the returned product, without delay and no later than 14 days after the day on which the consumer notifies it of the withdrawal. Unless Britstyle Boutique offers to collect the product itself, then it can wait to refund until it has received the product or the consumer proves that he has returned the product, whichever is earlier.
    Britstyle Boutique will use the same means of payment that the consumer used for the refund, unless the consumer agrees to a different method. The refund is free of charge for the consumer.
    If the consumer has chosen a more expensive shipping method than the cheapest standard shipping method, Britstyle Boutique does not have to refund the additional costs for the more expensive shipping method.

    Article 9 - Exclusion of the right of withdrawal

    Britstyle Boutique may exclude the following products and services from the right of withdrawal, but only if Britstyle Boutique has clearly stated this in the offer or at least in good time before the conclusion of the contract:

    Products or services whose price depends on fluctuations in the financial market over which Britstyle Boutique has no influence and which may occur within the withdrawal period;

    Contracts concluded in the context of a public auction. A public auction means a sales method in which products, digital content and/or services from Britstyle Boutique are offered to the consumer who is personally present or is given the opportunity to be personally present, under the direction of an auctioneer, and where the successful bidder is obliged to purchase the products, digital content and/or services;

    Service contracts after full execution of the service, but only if:
    the execution has begun with the express prior consent of the consumer; and

    the consumer has declared that he will lose his right of withdrawal as soon as Britstyle Boutique has fully performed the contract;

    Service contracts for the provision of accommodation, if the contract provides for a specific date or period for its execution, other than for residential purposes, the transport of goods, car rentals and catering;
    Contracts related to leisure activities, if the contract provides for a specific date or period for their execution;
    Products manufactured according to the consumer's specifications, which are not prefabricated and which are manufactured based on an individual choice or decision of the consumer or which are clearly intended for a specific person;
    Products that spoil quickly or have a limited shelf life;
    Sealed products which are not suitable for return for reasons of health protection or hygiene and whose seal has been removed after delivery;
    Products which, due to their nature, are irreversibly mixed with other products after delivery;
    Alcoholic beverages, the price of which was agreed upon conclusion of the contract but whose delivery can only take place after 30 days and whose actual value depends on fluctuations in the market over which Britstyle Boutique has no influence;
    Sealed audio and video recordings and computer programs which have been unsealed after delivery;

    Newspapers, periodicals or magazines, with the exception of subscriptions thereto;

    The supply of digital content which is not supplied on a physical medium, but only if:

    performance has begun with the consumer's explicit prior consent;

    and

    the consumer has declared that by doing so he loses his right of withdrawal.

    Article 10 - The price

    During the period of validity stated in the offer, the prices of the products and/or services offered will not be increased, unless these are price changes due to changes in VAT rates.

    By way of derogation from paragraph 1, Britstyle Boutique may offer products or services whose prices are linked to fluctuations in the financial market and over which Britstyle Boutique has no influence, at variable prices. This link to fluctuations and the fact that any prices stated are indicative prices will be stated in the offer.

    Price increases within 3 months after the conclusion of the contract are only permitted if they are based on legal regulations or provisions.

    Price increases from 3 months after the conclusion of the contract are only permitted if Britstyle Boutique has agreed this and:

    these are based on legal regulations or provisions; or

    the consumer has the right to terminate the contract from the day on which the price increase takes effect.

    Delivery takes place in accordance with Article 5 paragraph 1 of the VAT Act 1968 in the country where the transport begins. In this case, delivery will take place outside the EU. As a result, import VAT or customs duties will be charged to the recipient by postal or courier services. The entrepreneur will therefore not charge VAT.

    All prices are subject to printing and typesetting errors. No liability is accepted for the consequences of printing and typesetting errors. In the event of printing and typesetting errors, the entrepreneur is not obliged to deliver the product at the incorrect price.

    Special additional customs and/or import duties are not included in the price and are at the expense of the customer.

    Article 11 - Fulfillment of the agreement and additional guarantee

    Britstyle Boutique guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of quality and/or usability and the legal provisions and/or government regulations applicable at the time of the conclusion of the agreement. If agreed, Britstyle Boutiquealso guarantees that the product is suitable for use other than normal use.
    An additional guarantee granted by Britstyle Boutique its supplier, manufacturer or importer never limits the legal rights and claims that the consumer can assert against Britstyle Boutique under the contract if Britstyle Boutique has failed to fulfil its obligations under the contract.

    An additional guarantee is understood to mean any obligation of Britstyle Boutique, its supplier, importer or manufacturer that grants the consumer certain rights or claims that go beyond the legal requirements in the event that Britstyle Boutiquehas failed to fulfil its part of the contract.

    Article 12 - Delivery and execution

    Britstyle Boutique will exercise the greatest possible care in receiving and executing orders for products and in assessing requests for the provision of services.
    The place of delivery is the address that the consumer has communicated to Britstyle Boutique.
    With due regard to the provisions set out in Article 4 of these General Terms and Conditions, Britstyle Boutique will execute accepted orders promptly, but no later than within 30 days, unless another delivery period has been agreed. If there are delays in delivery or an order cannot be executed in whole or in part, the consumer will be informed of this no later than 30 days after placing the order. In this case, the consumer has the right to terminate the agreement without incurring any costs and, if applicable, to claim compensation.
    After termination in accordance with the previous paragraph, Britstyle Boutique will immediately refund the amount paid by the consumer.
    The risk of damage and/or loss of the products is borne by Britstyle Boutique until delivery to the consumer or a previously designated representative known to Britstyle Boutique, unless expressly agreed otherwise.

    Article 13 - Continuing contracts: duration, termination and extension

    Termination:

    The consumer can terminate a contract that has been concluded for an indefinite period and relates to the regular delivery of products or services at any time, subject to the agreed termination rules and a notice period of no more than one month.

    The consumer can terminate a contract that has been concluded for a definite period and relates to the regular delivery of products or services at any time at the end of the fixed term, subject to the agreed termination rules and a notice period of no more than one month.

    The consumer can terminate the contracts referred to in the previous paragraphs:
    at any time and not be limited to termination at a specific time or within a specific period;
    terminate at least in the same way as these contracts were concluded by him;
    terminate at any time with the same notice period as agreed by Britstyle Boutique for itself.

    Extension:

    A contract that has been concluded for a definite period and relates to the regular delivery of products or services may not be tacitly extended or renewed for a specific duration.
    By way of derogation from the previous paragraph, a contract concluded for a definite period may be tacitly renewed for a definite period of no more than three months if the consumer can terminate this extended contract at the end of the extension with a notice period of no more than one month.

    A contract concluded for a definite period and relating to the regular delivery of products or services may only be tacitly renewed for an indefinite period if the consumer can terminate at any time with a notice period of no more than one month.

    Duration:

    If a contract has a duration of more than one year, the consumer can terminate the contract at any time after one year with a notice period of no more than one month, unless reasonableness and fairness preclude termination before the end of the agreed term.

    Article 14 - Payment

    Unless otherwise stipulated in the contract or the additional conditions, the amounts owed by the consumer must be paid within 14 (fourteen) days after the start of the cooling-off period or, if there is no cooling-off period, within 14 (fourteen) days after the conclusion of the contract. In the case of a contract for the provision of a service, this period begins on the day after the consumer receives confirmation of the contract.
    In sales of products to consumers, the general terms and conditions may never require the consumer to pay more than 50% in advance. If an advance payment has been agreed, the consumer cannot assert any rights with regard to the execution of the relevant order or service(s) before the agreed advance payment has been made.
    The consumer is obliged to immediately report any inaccuracies in the payment details provided or displayed to Britstyle Boutique.
    If the consumer fails to meet his payment obligations on time, after Britstyle Boutique has informed him of the late payment and Britstyle Boutique has granted the consumer a period of 14 (fourteen) days to meet his payment obligations, after this 14-day period has expired, he will be entitled to pay the statutory interest on the outstanding amount and Britstyle Boutique will be entitled to charge the extrajudicial collection costs incurred. These collection costs will amount to a maximum of: 15% of the outstanding amount up to € 2,500; 10% over the next € 2,500 and 5% over the next € 5,000, with a minimum of € 40. Britstyle Boutique may deviate from the amounts and percentages mentioned in favor of the consumer.

    Article 16 - Complaints procedure

    Britstyle Boutique has a sufficiently publicized complaints procedure and handles the complaint in accordance with this procedure.

    Complaints about the execution of the agreement must be submitted to Britstyle Boutiquein a complete and clear manner within a reasonable time after the defects have been discovered.

    Complaints submitted to Britstyle Boutique will be answered within 14 (fourteen) days from the date of receipt. If a complaint requires a foreseeably longer processing time, Britstyle Boutique will respond within the 14 (fourteen) day period with an acknowledgement of receipt and an indication of when the consumer can expect a more detailed answer.

    Article 17 - Disputes

    Only Dutch law applies to agreements between Britstyle Boutique and the consumer to which these general terms and conditions apply. All disputes arising from the agreement and/or these general terms and conditions will be submitted to the competent court in the district where Britstyle Boutique is established.

    Article 18 - Additional or deviating provisions

    Additional or deviating provisions from these general terms and conditions must not be to the detriment of the consumer and must be recorded in writing or in a way that allows the consumer to store them in an accessible manner on a durable medium.

    Article 19 - Rejection of orders

    In case of refusal of an order during delivery, the costs of returning and processing the items of your order are at your expense. The costs of restocking are € 10 per order + the shipping costs of € 7.30.

    If an item is brought to a collection point after you have not been at home and you have not picked it up within the agreed time frame, this will be considered a refusal of an order.
